I was watching the crappy Newcastle v Hertha Berlin game the other night and the commentators began talking about the Toon's recent signing, Gutierrez. They mentioned how the player had got himself out of his contract with Mallorca using FIFA's Webster ruling, so that Newcastle were able to buy him. Now, if I understand it correctly, the Webster ruling allows a player to cancel a contract themselves having been at a club for so many years. If the player is under 28 then they have to have been there for at least 3 years, while if a player is over 28 they only need be there for 2. Therefore, surely Berba qualifies for this ruling and if he truly wanted to leave the Lane that bad, he might've taken this option. Having said that , it is absolutely a last resort. It probably involves the player having to match their buy-out clause or something also which, for Berba, would probably be quite alot but then he would know that Man United or whoever would be prepared to pay it for him anyway.
Is there anyone who can explain this ruling to me a bit better and, if so, offer up some reason as to why Berba would not have taken it other than he might not want to leave us as badly as its being made out?

Since there has - as far as I can work out - only been one such case (i.e. that of Andy Webster himself), it seems there is still significant ambiguity regarding who is due what. It would seem the compensation payable by a player to the club equates to his salary for the remainder of his contract, although that seems far from clear in the Webster case.

I would seriously doubt whether a player can get the club he joins after invoking the ruling to then reimburse him for the compensation he has paid to the club he has left. Probably leaves him open to all sorts of legal proceedings! But what do I know? I'm not in the legal profession.
The question "does he want to leave". Dont think so he just wants to win things and play in the CL. If we could give him that he would stay for sure.
Watched that vid on the carling site and the passion when he bagged that pen, was what i would love him to demonstrate week in and week out.

I 100% agree with you P Unit. Last year, when Man U were courting him according to greasy Dantchev, he claimed he was not going to leave Spurs despite all the speculation when he was being interviewed on the telly. I don't reckon the situation has changed all that much. He has never publicly stated the wish to go to Old Trafford, just that he likes the way Manure play. He has only ever spoken fondly about Tottenham. Its amazing how quickly he gets labeled a sulk. During the Norwich game, once it was known he wasn't going to play, the media were falling over themselves to print what a moody git he was. All I saw of him on the telly was him laughing & signing autographs. Didn't look at all upset.

It was reported yesterday that Coloccini was apparently threatening to activate article 17 (the Webster ruling) unless Depor let him leave. Its seems to be getting more common.

I think he is considering his options and Levy and Rambo have laid their cards on the table and Fergie hasnt actually made a bid which probably means he is looking else where and if it dont happen he will sniff around again. He probably dont like being 2nd or third choice either!!!

Yup as spurs fans we've always been the " if you dont want to be here the**** off " type and that will never change no matter how good he is, i think we've all seen whats possible with out him but id rather not see a rush panic buy to replace him when he's gone, I think that he's on a condisional sale where he's a done deal but cant leave until we have replaced him
There aint a replacement for him in my opinion.
Any player we get will be totally different and less skillfull for a forward in my opinion. There ait many forward players, soz any in my opinion that are as skilfull as him. He is deadly when he wants to be.
We will get an out and out goal scorer or a work-horse. The closest thing would be Villa, but to say he's a replacement would be silly he is a different player all together.
Ramos knows what he's doing and he will know if he's staying or not.
